CurbGenie Privacy Policy

This Privacy Policy ("Policy") describes the practices of CurbGenie, Inc., including its subsidiaries, affiliates, successors, assigns, and related entities, whether now existing or hereafter formed (collectively, "CurbGenie," "we," "our," or "us"), regarding the collection, use, storage, retention, disclosure, sale, licensing, transmission, analysis, and other processing (collectively, "Processing") of information relating to individuals and entities who access, interact with, request services from, provide services through, are subject to verification by, or are otherwise affected by CurbGenie's platform, websites, tools, software development kits, application programming interfaces, mobile applications, communications systems, security systems, and related technologies and operations (collectively, the "Services"). This Policy applies to both individuals who request or receive services ("Customers," "Users," or "you") and individuals or entities who provide services through or in connection with the Services as independent third-party providers ("Contractors," "Providers," or "you"), and also applies to any other person whose information is collected in connection with the Services, including representatives, authorized users, passengers, renters, vehicle owners, payors, payees, business customers, and individuals who communicate with us.

Your access to or use of the Services constitutes your acknowledgement that you have read, understood, and agree that your information may be processed as described in this Policy. If you do not agree, you must not access or use the Services.

This Policy is intended to be interpreted broadly, and to the maximum extent permitted by applicable law.

1. Scope of This Policy

This Policy applies to the Processing of information in connection with the Services, including where such information is collected through (i) our mobile applications, websites, or web portals; (ii) in-app workflows including booking, pickup, confirmation, vehicle transfer and completion; (iii) customer support communications; (iv) marketing communications; (v) background screening, identity verification, and eligibility monitoring; (vi) integrations with third-party services; and (vii) offline sources, where such information is subsequently associated with the Services.

To the maximum extent permitted by law, this Policy may apply to conduct occurring outside the Services when such conduct is reasonably relevant to the safety, integrity, operational reliability, compliance obligations, fraud prevention, risk management, dispute resolution, or reputation of CurbGenie or the Services. This includes circumstances where we receive such information from third parties, public sources, or governmental authorities.

2. Information We Collect and Receive

CurbGenie collects, receives, generates, infers, and otherwise Processes information from multiple sources in order to operate, secure, improve, commercially operate, market, and expand the Services. The categories of information we collect and receive may include, without limitation, the following, as applicable to your use of or interaction with the Services:

CurbGenie may collect information you provide directly, including account creation information such as your name, email address, telephone number, password, billing address, date of birth (where required), identity documentation, payment method information, and other account details. If you initiate a service request, we may collect information relating to your booking, rental vehicle details, flight details, pickup and drop-off data, location information, communications with Contractors and customer support, confirmations relating to vehicle condition, and information you provide regarding incidents, disputes, or service issues. If you are a Contractor, we may collect application details, identity details, driver's license details, insurance information, vehicle information (where applicable), tax documentation, bank account or payout information, and other eligibility-related data.

CurbGenie may collect information automatically or passively through your use of the Services, including through cookies, software development kits ("SDKs"), device permissions, and other automated means. This information may include internet protocol (IP) address, device identifiers (excluding advertising identifiers), browser and operating system information, mobile carrier details, device settings, crash logs, event logs, clickstream data, diagnostic information, performance telemetry, app usage data, feature interaction data, and other analytics information. Such information is used for internal analytics, service functionality, fraud prevention, security, system integrity, debugging, performance optimization, and operational purposes, and is not used for targeted advertising or cross-context behavioral tracking.

CurbGenie may collect, receive, or infer information regarding your location. Depending on your device settings and permissions, this may include approximate location derived from IP address and network data, or precise geolocation derived from GPS, Bluetooth, Wi-Fi, or other device-based signals. Location information may be collected when the app is open, when it is running in the background (if permitted), and when you are interacting with service workflows that require location confirmation.

CurbGenie may collect and process communications information, including communications between Users and Contractors, communications between you and CurbGenie (including customer support calls, email communications, chat messages, and other interactions), and metadata associated with such communications. To the maximum extent permitted by law, we may monitor, review, record, store, or analyze communications for quality assurance, training, safety, fraud prevention, dispute resolution, enforcement, and compliance purposes.

CurbGenie may obtain information from third parties, including verification providers, background check providers, identity verification vendors, motor vehicle record agencies, government databases, credit bureaus (where permitted), fraud prevention vendors, analytics vendors, communications service providers, social networks (where you choose to interact with us), airport operators, rental car companies, and other partners. Such information may be combined with information we already possess to enhance accuracy, reliability, compliance, fraud prevention, and monetization.

CurbGenie may also generate, infer, and derive data, including behavioral profiles, predictive risk scores, reliability indicators, fraud likelihood assessments, service quality metrics, operational performance models, and user segmentation data. Such inferred data may be used for business operations, security, marketing (as permitted under this Policy), personalization, and internal commercial and operational purposes, as permitted by law.

No Tracking Disclosure. CurbGenie does not track users across third-party apps or websites, does not combine personal information with third-party data for advertising purposes, and does not disclose personal information for advertising measurement or tracking. CurbGenie does not use the App to collect data for advertising measurement purposes.

3. Contractor Identity Verification, Background Checks, and Ongoing Eligibility Monitoring

If you are a Contractor, or if you apply to become a Contractor, you expressly acknowledge and agree that CurbGenie may collect, use, disclose, and verify information relating to your identity, eligibility, and fitness to provide services through or in connection with the Services. This includes the right to request and verify personal identity information, perform identity verification checks, and authenticate documentation you provide, including government-issued identification, driver's license credentials, and proof of eligibility to work or provide services, to the extent permitted by law.

You further acknowledge and agree that CurbGenie may perform, directly or through one or more third-party vendors, background checks and ongoing background monitoring, including criminal background checks, sex offender registry checks, motor vehicle record checks, license status checks, driving history checks, arrest record checks (where legally permissible), court record checks, and other screening or safety-related checks. Such checks may be conducted at onboarding, periodically thereafter, and at any time we reasonably determine necessary for safety, risk management, compliance, fraud prevention, or enforcement purposes.

You also acknowledge and agree that CurbGenie may verify the status, validity, and standing of your driver's license and may re-verify license status periodically or continuously, including through access to motor vehicle agencies, third-party monitoring services, or other lawful data sources. CurbGenie may also verify insurance coverage, eligibility, and compliance with applicable safety and platform standards.

Where permitted by law, CurbGenie may retain screening results and eligibility information for as long as necessary for safety, compliance, and operational needs, including for purposes of responding to claims, disputes, insurance matters, and legal inquiries, and may share such information with third-party vendors, partners, insurers, and governmental authorities as necessary or appropriate in connection with the Services.

4. Device Permissions, Device Data, and Access to Device Features (Users and Contractors)

In connection with the Services, and subject to the permissions you grant on your device and the settings you select (or that are enabled by default on your device), CurbGenie may access, collect, and process certain information and data stored on or generated by your computer, tablet, mobile phone, or other internet-connected device ("Device"). This may include data and signals generated through your Device's hardware, software, and sensors, and may include access to and use of your Device camera (including for identity verification, document capture, and incident reporting), photo library or media storage (including to upload documentation, evidence, vehicle condition photos, or other requested content), microphone (including for customer support or communications features), contacts (including for referral or invitation features where enabled), and location services (including GPS, Bluetooth, Wi-Fi signals, and other geolocation sources).

CurbGenie may also collect and process Device-level data and identifiers, including Device ID (excluding advertising identifiers), browser fingerprints, operating system version, network and carrier information, language settings, time zone, app version, battery status, and other diagnostic indicators. Such information may be used for fraud prevention, security, system integrity, account authentication, bot detection, duplicate account identification, enforcing Terms, ensuring proper app function, detecting suspicious activity, enabling transaction processing, preventing abuse of promotions, and optimizing the Services.

Device data and permissions are used solely to provide, secure, and support the Services, including account authentication, transaction processing, customer support, fraud prevention, abuse detection, system integrity, and service optimization. CurbGenie does not use Device data for targeted advertising, cross-context behavioral advertising, retargeting, lookalike audience creation, or cross-device tracking, and does not use advertising identifiers (such as IDFA).

5. Marketing Communications, Service Updates, and Internal Personalization

CurbGenie may use information it collects to communicate with Users and Contractors regarding the Services, including service confirmations, operational notices, security alerts, support responses, policy updates, and other communications reasonably related to the Services or an existing relationship.

Where permitted by law, CurbGenie may also use contact information to send informational or promotional communications about CurbGenie's own services, features, or offerings. You may opt out of non-essential promotional communications through available unsubscribe mechanisms or account settings, where applicable.

CurbGenie may use information to personalize the user experience within the Services, such as remembering preferences, service history, saved locations, or operational settings.

CurbGenie does not engage in targeted advertising, cross-context behavioral advertising, retargeting, lookalike audience creation, or tracking users across third-party apps or websites. CurbGenie does not use advertising identifiers and does not sell personal information or share personal information with data brokers.

6. Disclosures of Information

CurbGenie may disclose information to Contractors to facilitate service performance, including to enable pickup, drop-off, identity confirmation, dispute handling, and operational coordination. CurbGenie may disclose information to Users as needed to facilitate transparency, safety, and transaction completion.

CurbGenie may also disclose information to third-party service providers and vendors who support our operations, including identity verification providers, background check providers, motor vehicle record agencies, payment processors, hosting providers, analytics vendors, communications service providers or service providers acting on our behalf, customer support vendors, insurers, and legal or compliance service providers.

CurbGenie may disclose information to government agencies, regulators, law enforcement, courts, and other parties where required by law, subpoena, or legal process, or where we determine disclosure is reasonably necessary to protect the rights, property, or safety of CurbGenie, Users, Contractors, third parties, or the public, including for fraud prevention, safety investigations, or enforcement of Terms.

CurbGenie may disclose or transfer information in connection with a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar transaction, including as part of due diligence or transaction completion, and such information may be transferred as a business asset to successors or acquirers.

7. Retention

CurbGenie retains information for as long as we determine, in our sole discretion and as permitted by law, is necessary for the purposes described in this Policy, including but not limited to service fulfillment, compliance, safety, risk management, fraud prevention, dispute resolution, litigation preparedness, accounting, auditing, business continuity, and the development, improvement, and commercialization of the Services (including future services), consistent with this Policy and applicable law.

We may retain aggregated, anonymized, de-identified, pseudonymized, or derived data indefinitely, including for product development, operational modeling, security, analytics, and commercialization.

8. Your Rights and Choices

Depending on the jurisdiction in which you reside, and subject to limitations and exceptions under applicable law, you may have the right to request access to, correction of, portability of, or deletion of certain personal information, and may have rights to opt out of certain categories of processing such as targeted advertising or certain commercial data sharing. You acknowledge that such rights may be limited where we have a lawful basis to retain information, including where retention is necessary for compliance, fraud prevention, enforcement, dispute resolution, and other legitimate business purposes.

Requests may be submitted to hello@curbgenie.com, and we may require verification of your identity prior to fulfilling a request. Where permitted by law, we may deny or limit a request if it cannot be authenticated, if it would compromise security or privacy of others, or if an exception applies.

9. Security

CurbGenie employs commercially reasonable administrative, physical, and technical safeguards designed to protect information against unauthorized access, use, alteration, disclosure, or destruction. However, no system can be guaranteed to be fully secure, and you acknowledge that transmission of information via the internet and storage systems involves inherent risk. You agree that CurbGenie shall not be responsible for unauthorized access to information where such access results from circumstances beyond CurbGenie's reasonable control.

10. Children

The Services are not directed to children under eighteen (18). We do not knowingly collect personal information from children under 18 without legally required consent. If we become aware that we have collected such information, we may take steps to delete it in accordance with applicable law.

11. International Processing

If you access the Services from outside the United States, you acknowledge and agree that your information may be transferred to, stored in, and processed in the United States and other jurisdictions where CurbGenie or its service providers operate, and that such jurisdictions may have data protection laws that differ from those in your location.

12. Changes to This Policy

We may amend this Policy at any time in our sole discretion. If we make changes, we may provide notice through the Services, by email, or through other reasonable means. Your continued use of the Services after changes become effective constitutes your acceptance of the updated Policy.

State Specific Privacy Addendum

1. State-Specific Disclosures and Consumer Data Rights Addendum

This Addendum shall be deemed a material part of this Policy and shall operate as an extension of such Policy for all purposes. It shall apply with full force and effect to all individuals who either reside in, are located in, or otherwise use the Services within, or are subject to the legal protections of, any jurisdiction within the United States that has adopted or enacted a consumer data privacy law granting individual rights with respect to the collection, use, retention, processing, sale, sharing, disclosure, or portability of personal information or personal data, including but not limited to the states of California, Virginia, Colorado, Connecticut, Utah, Texas, Montana, Oregon, Delaware, Indiana, Tennessee, Iowa, and New Jersey (each a "Covered State" and collectively the "Covered States").

For the avoidance of doubt, this Addendum is intended to apply both to users of the Services ("Users") and to independent contractors, vendors, service providers, and other entities or individuals who provide goods or services to or through the CurbGenie platform ("Contractors"), in each case to the extent they are covered by applicable law. This Addendum is structured and intended to be construed in accordance with, and not in conflict with, such state laws, and shall be deemed modified to the extent necessary to conform to state-specific requirements. In the event of any conflict between this Addendum and the main body of this Policy, the terms of this Addendum shall control for residents of the applicable Covered State.

1.1 Consumer Rights Under State Privacy Laws

Residents of Covered States may, subject to statutory limitations and verification procedures, have one or more of the following rights in connection with their personal data:

  • The right to request that CurbGenie confirm whether personal data about the consumer is being processed, and the right to access such personal data in a portable, readily usable, and, where technically feasible, machine-readable format.
  • The right to request that CurbGenie correct inaccuracies in personal data concerning the consumer, taking into account the nature of the personal data and the purposes of the processing.
  • The right to request that CurbGenie delete personal data provided by or obtained about the consumer, subject to exceptions related to legal obligations, security incidents, fraud prevention, dispute resolution, and legitimate business interests.
  • The right to opt out of the processing of personal data for purposes of (i) targeted advertising, to the extent such processing occurs, as defined by the laws of each Covered State; (ii) the sale of personal data, including transfers for monetary or other valuable consideration; and (iii) profiling in furtherance of decisions that produce legal or similarly significant effects concerning the consumer, to the extent such rights are recognized by the consumer's jurisdiction.
  • The right to appeal any denial or rejection of a consumer data rights request by submitting a written notice of appeal in accordance with the contact instructions set forth in this Addendum. CurbGenie will provide a written explanation of the reason(s) for any denial of appeal, in accordance with applicable law.

These rights may be exercised by submitting a verified request through the contact channels identified in this Addendum. CurbGenie reserves the right to deny any request that cannot be authenticated, that is manifestly unfounded or excessive, or that conflicts with a legal obligation, or that would violate the rights of another person.

1.2 Categories of Personal Data Processed

For purposes of compliance with the laws of Covered States, and to the extent applicable to the user or Contractor in question, CurbGenie collects, processes, and may disclose the following categories of personal data: identifiers (such as name, address, email, phone number, IP address, and device ID); commercial information (including service interactions, payment history, and transaction data); location data (both precise and approximate); electronic network activity data (including cookies, app usage, and interaction logs); audio or visual recordings (including security and customer support recordings); employment-related data (in the case of Contractors); sensitive personal information (as defined under California and other laws); and any inferences drawn from the foregoing to create consumer profiles.

CurbGenie may retain such data for the duration necessary to fulfill the purposes for which it was collected, including compliance with contractual obligations, the pursuit of legitimate interests, risk management, and future development, unless a longer retention period is legally required.

1.3 Sale and Sharing of Personal Information

Pursuant to the definitions established under the California Consumer Privacy Act as amended by the California Privacy Rights Act ("CPRA"), and similar statutes enacted in other Covered States, the terms "sale" and "share" may include certain disclosures of personal information to third parties in exchange for monetary or other valuable consideration, or for purposes of cross-context behavioral advertising.

CurbGenie does not sell personal information and does not share personal information for purposes of cross-context behavioral advertising, as those terms are defined under applicable law.

To the extent required by applicable law, CurbGenie nevertheless provides consumers with the ability to submit requests to opt out of the sale or sharing of personal information by contacting hello@curbgenie.com or through other legally required mechanisms. CurbGenie also honors legally valid browser-based opt-out signals, such as the Global Privacy Control (GPC), where required.

1.4 Processing of Sensitive Personal Data

In jurisdictions that require special treatment of sensitive personal data—such as California, Colorado, and Virginia—CurbGenie may collect, use, or disclose the following categories of sensitive data: government-issued identifiers (e.g., driver's license or state ID), account login credentials, financial account information, exact geolocation, racial or ethnic origin (if voluntarily disclosed), and biometric information (if applicable). The collection of such data is used solely for permitted purposes under applicable law, such as service provisioning, fraud prevention, platform security, legal compliance, and internal operations.

CurbGenie does not use sensitive personal data to infer characteristics about any user or Contractor, except where permitted by law. Where opt-in consent is required, such consent will be obtained through affirmative mechanisms as prescribed by law.

1.5 Authorized Agents and Requests on Behalf of Others

Where applicable law permits consumers to appoint an authorized agent to act on their behalf, CurbGenie shall honor such designation only upon satisfactory verification of the agent's authority and identity, as well as verification of the consumer's identity, unless the request is made pursuant to a power of attorney under a valid state statute.

CurbGenie reserves the right to deny any request submitted through an agent who fails to provide sufficient proof of authorization or where the identity of the consumer cannot be reasonably verified.

1.6 Appeals Process

Consumers in jurisdictions such as Virginia, Colorado, and Connecticut have the right to appeal the denial of a consumer data rights request. To initiate an appeal, the consumer must send a written request to hello@curbgenie.com with the subject line "Appeal of Data Rights Decision" and include the original request reference ID (if any). CurbGenie will review the appeal in accordance with its internal procedures and respond within the timeframe mandated by applicable law, including providing a statement of reasons if the appeal is denied.

1.7 Contact Information for State-Specific Requests

Requests will be evaluated in good faith and subject to verification requirements. Consumers will not be penalized, retaliated against, or discriminated against for exercising any rights granted under state privacy laws.
